1. Acceptance of terms
These Terms & Conditions ("Terms") form a binding agreement between you and AI Photo Fixer ("we", "our", "us") and govern your access to and use of the AI Photo Fixer mobile application, websites, and any related services (collectively, the "Service"). By downloading, installing or using the Service you confirm that you have read, understood and agree to be bound by these Terms.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
3. License to use the app
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, for your personal, non-commercial use only.
4. Your account
Some features require you to create an account or sign in with a third-party provider. You are responsible for the activity that occurs under your account and for keeping your credentials secure. Please notify us immediately if you suspect unauthorized use of your account.
5. User content
The Service lets you upload photos and other content ("User Content"). You retain all rights in your User Content. You grant us a limited, worldwide, royalty-free license to host, transmit, process and display your User Content solely for the purpose of operating and providing the Service to you (for example, running the AI enhancements you request and returning the result).
You represent and warrant that (a) you own or have the necessary rights to your User Content; and (b) your User Content does not violate these Terms, applicable law, or the rights of any third party.
6. Acceptable use
You agree not to use the Service to:
- Upload content that is unlawful, infringing, defamatory, or invasive of privacy.
- Generate or share sexual content involving minors, or non-consensual intimate imagery.
- Impersonate another person or misrepresent your identity or affiliation.
- Attempt to reverse engineer, decompile, or extract the underlying models or source code.
- Interfere with, overload or disrupt the Service or any servers or networks connected to it.
- Use automated means (bots, scrapers, etc.) to access the Service without our written permission.
7. Subscriptions & payments
Certain features of the Service require a paid subscription. Subscriptions are billed through the relevant app store (e.g. Apple App Store or Google Play) and renew automatically at the end of each billing cycle unless cancelled at least 24 hours before the renewal date.
- Pricing and the current list of features for each plan are shown in the app at the time of purchase.
- You can cancel or manage your subscription at any time through your app store account settings.
- Refund requests are handled by the app store you purchased from, according to their refund policies. We are not able to issue refunds directly for app store purchases.
8. Intellectual property
The Service, including its software, AI models, user interface, designs, logos and trademarks, is owned by us or our licensors and is protected by copyright, trademark and other laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell or lease any part of the Service.
9. Third-party services
The Service integrates third-party services for analytics, crash reporting, payments and other functionality (for example, Firebase, RevenueCat / Apple & Google in-app purchases, AppsFlyer, and Apple's App Tracking Transparency framework). Your use of those features may be subject to the third party's own terms and privacy policies, which we encourage you to review.
10. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. We disclaim, to the maximum extent permitted by law, all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the AI outputs will be accurate, error-free, or suitable for any particular use.
11. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD 50.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we believe it is necessary to protect the Service or other users. You may stop using the Service at any time by uninstalling the app and cancelling any active subscriptions through your app store.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice in the app. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which AI Photo Fixer is established, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local law gives you the right to bring proceedings elsewhere.
